General terms and conditions of SKF Hospitality GmbH, Bavariaring 29, 80336 Munich for the product SVYT - The executive space (including in 80333 Munich, Maximiliansplatz 9).

§ 1 General 

(1) The following General Terms and Conditions apply to all services provided by SKF Hospitality GmbH in connection with the product SVYT - The Executive space., hereinafter SVYT, to its customers/contractual partners. Terms and conditions of the customer that contradict these GTC or go beyond them are not valid without express written confirmation by SVYT.
(2) The offer is aimed at both private customers and entrepreneurs. Entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in exercise of their commercial or independent professional activity.

§ 2 Description of Services 

(1) The subject of the offers and services from SVYT is the provision of "workplaces" including internet use (WLAN, depending on technical availability), the provision of meeting rooms and the provision of mailboxes within the framework of the tariffs offered. SVYT is basically an addition to the classic office and is primarily used for meeting and exchanging people, as well as for light office work (mobile work) on the go.
(2) Depending on the selected tariff, the possibility of use is limited to a specific type of use and/or a specific time.
(3) Access is subject to availability only and cannot be guaranteed. No bandwidth or permanent availability is guaranteed for additional services such as WLAN.

The following tariffs are currently offered, all including internet use (WLAN):

1. 2H ticket: 2-hour usage authorization (possibly with a corporate card for a defined number of days - 2 hours of usage authorization each) after prior booking and payment via the booking tool on freely selectable weekdays from Monday to Friday at changing "workplaces" (in Lounge, Deli and CoWo area) within the opening hours either from 9 a.m. to 6 p.m., depending on availability and occupancy.
Taking a guest with you is included for 2 hours. To take the second guest or more, even for a stay shorter than 2 hours, the user is obliged to purchase a guest ticket before access.
2. Day ticket: 1-day usage authorization (possibly with corporate card for a defined number of days - one day usage authorization each) after prior booking and payment via the booking tool on freely selectable weekdays from Mon - Fri at changing "workplaces" (in Lounge, Deli and CoWo area) within the opening hours either from 9 a.m. to 6 p.m., depending on availability and occupancy.
Taking a guest with you is included for 2 hours. To take the second guest or more, even for a stay shorter than 2 hours, the user is obliged to purchase a guest ticket before access.
3. Half-day meeting rooms: ½-day usage authorization (possibly with a corporate card for a defined number of days - ½-day usage authorization each) after prior booking and payment via the booking tool from Monday to Friday during opening hours either from 9 a.m. to 9 p.m 1 p.m. or from 2 p.m. to 6 p.m., depending on availability and occupancy.
4. All-day meeting rooms: 1-day usage authorization (possibly with a corporate card for a defined number of days - ½-day usage authorization each) after prior booking and payment via the booking tool from Monday to Friday during the opening hours either from 9 a.m. to 9 p.m 6 p.m., depending on availability and occupancy.
5. Postal address: Separate establishment of a c/o address combined with a post folder, post acceptance and storage. A weekly mail forwarding can be booked for an extra charge. Otherwise, the customer ensures that his mail is collected regularly (at least every 10 days).
The notice period for this tariff is four weeks to the end of the month for both parties. After termination of the user relationship, the customer must collect the mail that has not yet been collected within two weeks. The mail is then returned to the sender with the note "Recipient moved".
6.     Gästeticket: The user of 2h or day ticket times are when taking more than one guest per stay/day obliged to purchase guest tickets. Purchase is also required should a guest stay longer than 2H. It is possible to convert a guest ticket into a day ticket.

§ 3 Access conditions, rules of conduct, booking and cancellation

(1) Access to SVYT is only possible all day during general opening times and subject to actual availability, except for users of the monthly space. The loss of keys must be reported immediately. This can be handed over against a deposit (see § 6 clause 5) and must be handed over immediately after the end of the tenancy. If you fail to return the rental agreement will be extended by another month.
(2) A transfer of access authorization to third parties is excluded.
(3) The rules of conduct are in the SVYT label (https://www.thesvyt.com/club-rules) that each user must confirm and comply with when booking.
(4) Meeting rooms must be reserved and booked in advance and canceled in good time.
Cancellation periods for the Meeting Suite "small" / "medium" / "large" rooms:
Up to 28 days before: 25% of the room rental
Up to 14 days before: 50% of the room rental
Up to 7 days before: 75% of the room rent, after that: 100% of the room rent.
(5) If possible in terms of time, the binding booking of a meeting room can be made up for within 6 months instead of being cancelled.
(6) Exclusive bookings of the entire space must be reserved, booked and canceled in good time in advance.
In principle, a processing and cancellation fee of EUR 250.00 plus statutory VAT will be charged, regardless of the time of cancellation.
In addition, the following costs, which depend on the time of cancellation, will be incurred. These are billed to the customer and are due immediately.
Cancellation deadlines for exclusive bookings of the entire space or parts of it:
Up to 6 weeks  before: 50% of the room rent
Up to 4 weeks before: 75% of the room rent
Up to 2 weeks before: 90% of the room rent,
afterwards: 100% of the room rent.

§ 4 Registration of customers
SVYT operates the homepage www.thesvyt.com  with the option of booking day and 2-hour tickets as well as meeting rooms via the booking tool. In order to successfully reserve the rooms, the amount due must have been paid in full via one of the payment systems integrated on the booking portal and SVYT must have confirmed the request. The customer must fill out the booking forms and agree to the general terms and conditions and data protection regulations. The data requested during registration must be given completely and correctly. If there is a change in the data provided after registration, the customer is obliged to notify SVYT of the changes immediately. 

§ 5 Conclusion of contract
(1) With the booking by the customer, a contract with SVYT is concluded according to the tariff selected by the customer.
(2) The contract is concluded via the booking portal. With the booking, the customer assures that the data provided is complete and correct. The customer undertakes to report changes to his personal data immediately (including via the booking portal in the case of repeated bookings or, if applicable, via a service portal).
(3) A user contract between the customer and SVYT is only concluded after the customer has paid the corresponding amount in full and SVYT has issued a declaration of acceptance/booking confirmation. This can be done in writing or by email.

§ 6 tariffs and payment methods, deposit 

(1) All SVYT prices are net prices plus statutory VAT at the rate of 19% and relate only to the specified services. Additional services are to be remunerated separately. The separately shown tariffs/prices of SVYT apply.
(2) Amounts due once are accepted immediately via the corresponding payment functions on the booking portal (e.g. via PayPal, credit card, Stripe, etc.). Different payment terms can be agreed for exclusive bookings. If the payments are monthly, the customer authorizes SVYT to collect the agreed fee by direct debit from a credit card or via PayPal. The customer can revoke the direct debit authorization at any time and without giving reasons.
(3) Bank charges and processing costs incurred by SVYT as a result of non-payment of the direct debit or as a result of an objection shall be borne by the customer.
(4) Payment is due immediately upon conclusion of the contract. If the payment is to be made monthly, it is due on the first of each month. The receipt of payment is decisive. If the customer is in arrears, SVYT reserves the right to charge interest on arrears at the legally standardized interest rate. The obligation to pay default interest does not exclude the assertion of further default damages. Culpable default of payment by the customer entitles SVYT to refuse access until the arrears have been settled.

§ 7 Data Protection & Liability 

(1) SVYT will observe the data protection regulations in accordance with the Federal Data Protection Act (BDSG) and the other statutory data protection regulations (DSGVO). Further information on data protection can be found on our website at https://www.thesvyt.com/datenschutz.
(2) his personal data necessary for the execution of the contract are stored on data carriers. All data will be treated confidentially by SVYT and will not be passed on to third parties. We assure you that your data will only be used for billing and internal communication with you.
(3) The customer has the right to revoke his consent at any time with effect for the future. In this case, SVYT undertakes to immediately delete the customer's personal data.
(4) We would like to point out that photos or videos can be taken in SVYT (e.g. at public events) that will be published on our website or on social media channels. If the customer does not agree that he may be seen there, he must inform us in writing.
(5) The customer agrees that when booking rooms, his company name or name in the room allocation plan will appear publicly on the website. If he does not want this, he must inform us in writing.
(6) SVYT has liability insurance and is liable for damage such as B. Injury to customers, if z. B. the chair collapses or property damage if z. B. a lamp falls on the laptop. Nevertheless, it is advisable to take out your own professional or business liability insurance. Furthermore, there is inventory insurance, which insures inventories held liable by SVYT. SVYT assumes no liability for the loss or theft of personal items and points out that any theft of third-party property will be prosecuted.
(7) SVYT has a firewall that wards off external attacks. Each user is responsible for updating their own antivirus program in order not to cause network damage internally. 

§ 8 Terminations 

(1) Both parties can terminate the contractual relationship within the contractually stipulated period without giving reasons. The right to premature termination for important reasons remains unaffected for both parties and for all cases. All terminations must be in writing.
(2) SVYT can terminate the contractual relationship with immediate effect without observing a notice period if there is a reason for extraordinary termination. This is the case if the customer is twice in arrears with his payment obligations or culpably violates his contractual obligations in any other way. Furthermore, if the basis for the usage relationship with the customer ceases to exist (termination of the main rental relationship).
(3) The customer can terminate the contractual relationship with immediate effect without observing a period of notice if the continuation of the user relationship cannot be expected of him.
(4) Place of jurisdiction is Munich.
